Appliance Repair Terms Of Use
1. Introduction
These terms and conditions of service apply to all appliance repair services provided by Appliance Mechanics. By scheduling a service call, using our services, or allowing our appliance repair technician to commence work, you acknowledge and agree to the terms and conditions set forth herein. It is your responsibility to familiarize yourself with these terms before service begins. Continued use of our services constitutes acceptance of all terms.
If you do not agree to these terms of service, you should not proceed with any appliance repair services provided by Appliance Mechanics.
2. Service Calls and Charges
2.1 Non-Refundable Service Charge
A service call fee is required for all visits, whether for diagnostic purposes or repairs. The fee is non-refundable, regardless of whether the repair service is completed. It covers the costs associated with travel and assessment by a professional appliance repair technician.
The service call fee will be quoted to you before scheduling the appointment and must be paid in full at the time of service. If the customer chooses to proceed with the repair, the service charge will be included in the total repair cost.
Sales tax and additional fees may apply depending on the type of appliance being serviced, the complexity of the repair, and the parts required to repair the appliance.
2.2 Payment Terms and Collection
Unless otherwise agreed in writing, payment for services performed is due upon completion. We accept cash, checks, and credit card payments. A $50 service charge will be added for any returned check or failed bank draft.
Customers agree to pay all fees associated with the collection of unpaid balances, including but not limited to legal fees, collection agency fees, and filing costs. Any past-due amount will accrue interest at 18% annually or the maximum allowed by law, whichever is lower.
3. Limited Warranty
3.1 Warranty Coverage
Appliance Mechanics provides a limited warranty on repair service and parts used during repairs. We warrant that all repairs, parts, and services will be free from defects in materials and workmanship for ninety days from the service date. If a defect occurs within the warranty period, the customer must notify Appliance Mechanics promptly.
At our discretion, we will replace the defective part or re-perform the appliance repair service at no additional cost.
3.2 Warranty Exclusions
The warranty does not apply to:
- Repairs on appliances used for commercial or industrial purposes
- Cosmetic or non-functional components such as knobs, doors, racks, shelves, or trim
- Water supply lines and plumbing connections associated with the appliance installation
- Appliances that have been moved from the original location of the service
- Repairs on appliances where replacement parts are no longer available from the manufacturer
Appliance Mechanics reserves the right to deny warranty claims if the customer has unpaid invoices or damages resulting from user negligence.
3.3 Disclaimer of Warranties
All warranties provided are exclusive and replace all other warranties, express or implied. Appliance Mechanics makes no warranty regarding conditions of merchantability or fitness for a particular purpose beyond the specific warranty outlined herein.
4. Limitation of Liability
4.1 No Responsibility for Indirect Damages
To the extent permitted by law, Appliance Mechanics shall not be responsible for any incidental, indirect, or consequential damages, including but not limited to property damage, food spoilage, water damage, or loss of business revenue due to failed appliance repairs.
4.2 Maximum Liability
Our total liability for damages shall not exceed the total amount paid by the customer for the specific appliance repair service in question.
5. Customer Responsibilities
5.1 Preparation for Service
The customer is responsible for ensuring the appliance is properly installed and serviceable. If modifications to the space are required to accommodate the appliance installation, the customer must complete those modifications before service is provided.
Appliance Mechanics is not responsible for any modifications necessary to fit replacement parts or new units into an existing space.
5.2 Waivers of Liability
Waiver of Damages When Moving Appliances
Moving appliances poses an inherent risk of damage to them and surrounding surfaces, including flooring, cabinetry, and countertops. The customer acknowledges that the technician is not required to move the appliance and assumes full responsibility for any damages if the technician does so at the customer’s request.
Waiver of Damages When Working with Water
Appliances connected to plumbing systems, such as dishwashers, washing machines, and refrigerators, may experience leaks or flooding. Appliance Mechanics is not responsible for damages related to water leaks or component failures beyond our direct control.
Waiver of Damages from Cooling Equipment Failure
Refrigeration units and cooling appliances contain complex components that may fail unexpectedly. Even after careful repair and maintenance, mechanical failures can lead to food spoilage, inconvenience, and revenue loss in commercial settings. Appliance Mechanics is not responsible for any damages resulting from a refrigeration unit’s failure after service.
Waiver of Damages from Lifting Glass Cooktops
Glass and ceramic cooktops are fragile and can crack when lifted during service. The adhesive to secure these surfaces may cause breakage when separating the glass from the unit. The customer acknowledges this risk and releases Appliance Mechanics from responsibility for damage to the cooktop during service.
6. Governing Law and Dispute Resolution
6.1 Jurisdiction
These terms and conditions shall be governed by and construed under the laws of the State of Washington without regard to conflicts of law principles.
6.2 Arbitration Agreement
Any disputes arising from these terms of service will be resolved through binding arbitration in Washington State in accordance with the Commercial Rules of the American Arbitration Association. Both parties agree to waive the right to pursue litigation in court, except for small claims matters or claims related to enforcing an arbitration decision.
7. Changes to Terms
7.1 Updates to These Terms
Appliance Mechanics reserves the right to update these terms at any time. Changes will be posted on our website, and continued use of our appliance repair services will constitute acceptance of the updated terms and conditions.
7.2 Review of Terms
Customers are encouraged to read these terms before scheduling a service call and familiarize themselves with all terms before allowing a technician to commence service. Appliance Mechanics recommends reviewing these terms periodically to stay informed about updates.
8. Entire Agreement
These terms and conditions of service represent the entire agreement between Appliance Mechanics and the customer and supersede any prior agreements, whether verbal or written. No modification to these terms shall be recognized unless made in writing and signed by both parties.
